Rules for using DawnVPN: eligibility, acceptable use, billing, disclaimers, and how to contact us. Virtual service; no uptime SLA unless we agree in writing.
Effective date: 19 September 2026 Last updated: 19 September 2026 Document version: 2026-09-19 1. Acceptance These Terms of Service (“Terms”) are a contract between you and TinyStone, operator of DawnVPN (registered legal entity to be published — see Privacy Policy §1). By creating an account, purchasing a plan, or using a DawnVPN client or the website, you agree to these Terms and to the Privacy Policy at https://www.tinystone.us/privacy. If you do not agree, do not use the service. 2. Eligibility You must be old enough to form a binding contract in your country and at least the age stated in the Privacy Policy (generally 18 for paid plans). You must not use the service if applicable law forbids it. You are responsible for complying with local law, including export controls and any rules on encryption or VPN use. 3. The service and availability DawnVPN provides encrypted tunnel connectivity and related account features (node list, traffic quota, exclusive servers where offered, support tickets). Node locations, protocols, and speeds depend on your plan and on network conditions. We do not promise a specific uptime, latency, unblocking result, or fitness for a particular website, game, or payment. Maintenance, attacks, provider outages, and force majeure may interrupt service. We will try to give notice of planned maintenance when practical. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” 4. Accounts Keep your username and password confidential. You are responsible for activity under your account. Do not share, rent, or resell credentials except as we expressly allow (for example a household device limit in your plan). Notify support if you suspect unauthorized use. We may require email verification before login or VPN use. 5. Acceptable use You may use DawnVPN for lawful personal or internal business connectivity. You must not: • commit or facilitate crime, fraud, or unlicensed gambling where illegal; • attack, scan, or disrupt other networks, including DDoS, port scanning, or brute force; • distribute malware, phishing, or unsolicited bulk email (we may block typical abuse ports such as SMTP); • infringe intellectual property or privacy rights; • mine cryptocurrency, operate open proxies/exit nodes for third parties, or run automated crawlers that harm the network, except as your plan expressly allows; • evade traffic quotas, device limits, or payment; • interfere with other customers or with our infrastructure; • use the service to violate a third party’s terms in a way that creates legal exposure for us. We may throttle, filter, or disconnect traffic that threatens the network. We do not generally inspect tunneled content, but we may act on abuse reports, node-level volume anomalies, and legally required notices. 6. Billing, subscriptions, and refunds Prices are those shown at checkout or in the app store at the time of purchase. Taxes may apply. Website payments are typically processed by Stripe; app-store purchases follow Apple or other store rules, including their billing and cancellation flows. Auto-renewal, if enabled, is charged by the processor or store until you cancel. Digital VPN time is generally non-refundable once provisioned, except where consumer law requires a refund, where the store’s mandatory refund policy applies, or where we agree in writing. Chargebacks opened in bad faith may lead to suspension. Unused traffic does not automatically roll over unless your plan says so. 7. Exclusive servers and add-ons If you order a dedicated or exclusive node, location availability, hourly or monthly fees, and setup time are as shown in the portal. Cloud-provider capacity can fail; we are not liable for a provider’s refusal to host a region. You remain bound by acceptable use on exclusive nodes. 8. Clients, updates, and third-party software Official clients may auto-update. You must not reverse engineer the service except as allowed by mandatory law. Open-source components keep their own licenses. We are not responsible for unofficial builds. 9. Intellectual property DawnVPN names, logos, and site content belong to TinyStone or its licensors. You receive a limited, revocable license to use official clients to access the service. You do not receive ownership of nodes or IP addresses. 10. Termination You may stop using the service and request account closure via support. We may suspend or terminate an account immediately for violation of these Terms, non-payment, legal risk, or harm to the network. On termination, VPN access ends; we handle leftover personal data as described in the Privacy Policy. Fees already paid are not refunded except as section 6 requires. 11. Disclaimers To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the VPN will hide you from a determined adversary, that any site will load, or that parental-control or split-routing features are error-free. 12. Limitation of liability To the maximum extent permitted by law, TinyStone, DawnVPN, and their operators, contractors, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, even if advised of the possibility. Our total liability for any claim relating to the service is limited to the fees you paid us for the service in the three months before the claim (or, if greater, the minimum amount that cannot be waived in your jurisdiction). Nothing in these Terms limits liability that cannot be limited (for example death or personal injury caused by negligence, or fraud). 13. Indemnity You will defend and indemnify us against claims arising from your misuse of the service, your content, or your breach of these Terms, except to the extent caused by our willful misconduct. 14. Governing law and disputes Until the registered legal entity and principal place of business are published, these Terms are governed by the laws of Singapore (location of the current control-plane hosting), without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence still apply and cannot be waived. Courts or tribunals that have jurisdiction over the operator may hear disputes; consumers may also use courts of their residence where the law so provides. Please contact support first so we can try to resolve the issue. 15. Changes We may update these Terms. Material changes will be posted at https://www.tinystone.us/terms and the version field on GET /api/public/terms will change. Continued use after the effective date constitutes acceptance, except where local law requires a fresh consent. 16. Contact https://www.tinystone.us/#/support [email protected] [email protected] (privacy requests) 17. Entire agreement These Terms and the Privacy Policy are the entire agreement for the service and supersede prior informal statements. If a provision is unenforceable, the rest remains in effect. If language versions conflict, the English text controls, except where a local law requires otherwise.
